Welcome to My Credit Plan, a Family Financial Education Foundation FICO Credit Score improvement program. Family Financial Education Foundation is a 501 (c) (3) nonprofit certified credit counselor licensed and/or authorized to do business in all 50 states. Credit Karma is not a credit repair organization or financial advisor as defined under federal law. Family Financial Education Foundation (sometimes referred to herein as “FFEF”) has exclusively licensed My Credit Plan for the use of its clientele to obtain a personal plan-of-action to improve their FICO credit scores.

Why is My Credit Plan Different?

My Credit Plan has been created by some of the nation’s credit score experts, including one of the leading experts who is nationally recognized. My Credit Plan is designed to help everyone improve their FICO Credit Scores, specifically the most commonly used lender’s credit score, the FICO Classic Credit Scores. The FICO Classic Credit Scores are utilized in most every mortgage transaction, and most lenders utilize this score model for auto, credit card and other loan transactions.

Other websites utilize other so-called ‘educational’ score models that are created from entirely different programs. There are almost always different (sometimes substantially) from the FICO Classic Credit Scores. These ‘educational’ scores are considered unreliable by most lenders and do not determine credit worthiness with most lenders. These scores are found with many common websites. Most websites will disclose that they offer a non-FICO credit scores.

The words “we,” “us,” and “our” means Family Financial Education Foundation / My Credit Plan and the words “you” and “your” means you, the individual(s) who is identified on the My Credit Plan account as the owner or authorized signer as the account holder. “Communication” means any periodic statement, authorization, agreement, disclosure, notice, or other information related to your My Credit Plan Account. By creating an account, and assessing and using My Credit Plan, you are agreeing to the Terms of Service of My Credit Plan and Family Financial Education Foundation. It is important to read this agreement to understand the provisions that may affect your legal rights.

The Products and Services of My Credit Plan

The products and services of My Credit Plan include My Credit Plan’s Analyzer, My Credit Plan’s Planner, My Credit Plan’s Qualifier, My Credit Plan’s software and applications, and any other services, content, tools, features, and products found on the My Credit Plan website. The terms and conditions have an effective date that is the date of when you create a My Credit Plan account and agree to the Terms of Conditions thereof. Family Financial Education Foundation reserves the right to make changes at its discretion to any part of the My Credit Plan program, and its products and services. This includes adding, modifying, suspending, discontinuing, terminating or withdrawing any services with My Credit Plan.

My Credit Plan Account

When you create a “my Credit Plan account,” you agree to provide accurate personal information including your legal name, address, social security number, email address, and any other personal information required to create a My Credit Plan account. FFEF/My Credit Plan will not be liable for any of mistakes, errors or omissions.

You are responsible for activities involving your My Credit Plan Account. You represent that you are at least 18 years of age, have a valid social security number and that you are the person creating the My Credit Plan account. You represent that all personal information is accurate and true. You will update your account to make changes to any personal information such as addresses or married names.

You hereby agree that you will not share any login information for My Credit Plan including passwords and other personal information to create, maintain or access My Credit Plan account.

Consent

When you create an account with My Credit Plan, you agree and grant permission to Family Financial Education Foundation to request your credit report, also known as a ‘lender’s’ credit report, from the three major credit agencies, Equifax, Experian, and TransUnion, and in accordance the Fair Credit Reporting Act. You also agree to FFEF making subsequent requests through your account program for you.

In My Credit Plan, all social security numbers and passwords are encrypted and employees of Family Financial Education Foundation cannot give such information over the phone, email or any other form of communication. Family Financial Education Foundation does not sell nor share your personal information to any outside entity.

In accordance with federal privacy laws and your instructions, Family Financial Education Foundation and My Credit Plan will not send a copy of your credit report to any outside individual or entity. If you would like an outside entity to have a copy of your credit report, you may request it from My Credit Plan and send a copy under your own discretion.

You also acknowledge that the credit report retrieved form My Credit Plan cannot be used by any outside entity in any financial transaction. Additionally, Family Financial Education Foundation does not guarantee or warranty the analysis or insight given for any financial offers. The analysis is for educational purposes only and the information retrieved through My Credit Plan cannot be used to guarantee credit or financial standing with any outside entity.

Requesting Your Tri-merge Credit Report / FICO Credit Scores

My Credit Plan will usually request your three-bureau credit report from Experian, Equifax, and TransUnion along with the three FICO Classic Credit Scores when you create a My Credit Plan account. You may also personally request an update to your credit report and FICO scores at any time. There is usually a charge affiliated with a personal request.

Family Financial Education Foundation requests reports based on the information provided by you and is not liable for any credit report / FICO score that is not successfully updated in your My Credit Plan account, due to inaccurate information. With such events, a refund will not be given.

Receiving Notices

All communications that we provide to you will be provided to you in electronic email at the email address you specify at enrollment, or by access to the My Credit Plan website that you will designate.

When you have a plan that automatically requests your credit report, My Credit Plan will email a notice to you no sooner than 72 hours before an update to your credit report and scores is requested. You retain the right to postpone or cancel this request up to 24 hours before Family Financial Education Foundation / My Credit Plan requests your credit report. Because of timing, your right to postpone or cancel less than 24 hours before a requested update may / or may not be honored. Family Financial Education Foundation reserves the right to change the timing of all notifications.

My Credit Plan will email you your FICO Credit Scores once they are retrieved unless you indicate otherwise. Family Financial Education Foundation and My Credit Plan will send a copy of your FICO credit scores to an outside entity only with your consent (online), direction and approval. This action will only last up to six months after enrollment. Any extension for such services much be approved from you. Family Financial Education Foundation reserves the right to change the timing of all notifications.

Monitoring My Credit Plan

To assure correct functionality with My Credit Plan, Family Financial Education Foundation reserves the right to monitor My Credit Plan electronically. Family Financial Education Foundation may access, use, preserve, transfer or disclose, at any time and without notice to you, any information as reasonably necessary to comply with any applicable law regulation or subpoena, or respond to any legitimate law enforcement or governmental request.

Family Financial Education Foundation may also monitor activities in order to assure accuracy to My Credit Plan, to enforce this agreement, to investigate potential violations, to protect the safety, integrity, security and equipment of My Credit Plan, or any third party, and / or detect, prevent fraud, security concerns, or technical issues related to My Credit Plan or the services of the business partners of Family Foundation Education Foundation.

From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s) or the content found at any particular company’s services or products. We have no responsibility for the content of the linked website(s) or the services and / or products they offer. You may not create a link from this website to another website or document without Family Financial Education Foundation’s prior written consent.

Prohibited Acts

You are not permitted to access an account in My Credit Plan in the name of another legal person without the permission of that person, legal spouses, guardians, or a court order. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offence.

You are not permitted to access or use My Credit Plan or any of its services in any jurisdiction if it is contrary to federal or state law, or regulation of that jurisdiction or if it would subject Family Financial Education Foundation to additional laws and regulations of such jurisdiction. Family Financial Education Foundation reserves the right to limit access and availability of My Credit Plan to any person or jurisdiction, at any time.

You are not permitted to use My Credit Plan to obtain a consumer credit report, FICO credit scores or other consumer information under false pretenses or in violation of the Fair Credit Reporting Act or applicable federal law. You may not use My Credit Plan that infringes on the rights of any individual or company, which may or may not violate federal or state law.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. All trade marks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.

Credit Repair Organizations

No certified credit repair organization is allowed to use the services of My Credit Plan or assess the information found within My Credit Plan website. Any violation of this provision will result in termination of the account and a prohibition of any further access to any My Credit Plan account or information. No refunds will be given.

My Credit Plan’s Analyzer, Planner and Qualifier

Neither FFEF nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. My Credit Plan has three distinct programs; Analyzer, Planner, and Qualifier. The content and materials found within these three programs, including its images, all text and visual images and interfaces, its information and data, and computer code and all related intellectual property rights are the property of My Credit Plan and Family Financial Education Foundation.

My Credit Plan’s Analysis and Planner are created and designed to identify steps to improve your credit standing and increase your FICO credit scores. There are instances in which FICO credit scores may decline from a particular action or the information is incomplete from the credit bureaus. You hereby agree that Family Financial Education Foundation and My Credit Plan will be held harmless and cannot be held liable in case FICO credit scores decline.

My Credit Plan’s Qualifier is designed to help you identify potential loan qualifications for mortgage, auto loans and credit cards. This information is for educational purposes only and does not guarantee your credit worthiness as seen by lenders. A financial service company must review every credit situation including review of any income and / or asset requirements. This information is not transferable and cannot be used by any outside party, lender, financial service company, or any other individual or entity that is providing services to you or on your behalf.

You are permitted to use My Credit Plan and its content found within for your personal benefit. You may not copy, reproduce, republish, recreate, reverse engineer, display or post, without the written consent of Family Financial Education Foundation.

The content of My Credit Plan is protected by the intellectual property laws of the United States, and there may be no reuse any of the information found with My Credit Plan without the written permission of Family Financial Education Foundation.

Terms

The term of your My Credit Plan account open is your choice. The term of the account is month to month. No sooner than after six months of having established your account and being in good standing, you may select another program with different options for updating your plan of action and FICO credit scores. Your new program will have a different monthly payment amount due. You agree to pay the amount that you have selected at enrollment and also the amount from any subsequent program changes in the future.

You may cancel and close your My Credit Plan account at any time. If you want to reinstate your account to an open status after you have closed your my Credit Plan account, you will pay a reinstatement fee of up to two months of payments from the prior plan.

Disclaimers

Family Financial Education Foundation provides services through My Credit Plan. All content, including results, services, information and materials as given “As Is” without any expressed or written warranty or condition on behalf of Family Financial Education Foundation and its partners. No written result or advice is a guarantee of results. Family Financial Education Foundation is not a lender, insurance company, or other financial service company and cannot approve any loan or other financial product. The information provided through My Credit Plan is information provided from partners whose purpose is to inform and educate a consumer. There is no guarantee that this information is accurate or will be the same when you apply with a financial service company. You assume all risk, improvement or damage that may result from any information, content or services found with My Credit Plan. You assume all responsible for any damage or loss of your data from the result of your damage or lost property that has had access to any information from My Credit Plan. You acknowledge that Family Financial Education Foundation and My Credit Plan acts solely as an intermediary between the major credit reporting agencies and FICO, and the consumer. Family Financial Education Foundation disclaims any liability for errors and omissions found with My Credit Plan and you hereby agree to hold FFEF harmless from any claim, damages or cause of action.

Limitation of Liability & Indemnification

You hereby acknowledge and agree that Family Financial Education Foundation and any of its representatives, owners, agents, officers, directors, affiliates, licensors are not liable to you or any other party for any incidental, consequential and / or punitive damages from a result of any correct or erroneous content found with My Credit Plan.

You agree to defend Family Financial Education Foundation and hold harmless Family Financial Education Foundation and its partners and affiliates against any claims, expenses, liabilities, legal fees, from any third party claims to My Credit Plan, its content, your use of its service, or your violation of this agreement, and failure to respect the intellectual property of My Credit Plan. You agree that in no event will the total and aggregate liability of Family Financial Education Foundation to you exceed $50.

You may not settle any claim in regard to My Credit Plan without the prior written consent of Family Financial Education Foundation. Family Financial Education Foundation reserves the right to assume the defense and control of any matter subject with My Credit Plan and any claims against it or Family Financial Education Foundation. You also agree to indemnify Family Financial Education Foundation and to fully cooperate in the defense of any such claims.

Dispute, Arbitration and Resolution

A third party arbitrator will mediate and resolve any and all disputes between you and Family Financial Education Foundation and its partners and affiliates.

You agree that every dispute arising in connection with this agreement will be resolved by binding arbitration. Both parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of this agreement, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. The arbitrator also has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

A party who intends to seek arbitration must first send a written notice of the dispute to the other by certified mail ("Notice"). FFEF’s address for Notice is:724 Front Street, Suite 340, Evanston, Wyoming 82930Attention: Legal Department. The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). You and FFEF agree to use good faith efforts to resolve the claim directly, but if you and FFEF do not reach an agreement to do so within 30 days after the Notice is received, you or us may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or FFEF must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. The arbitration proceedings, including any exchanged materials, shall be confidential and you and FFEF agree to use reasonable efforts to streamline the proceedings, including discovery, consistent with the objectives of efficient dispute resolution.

You and Family Financial Education Foundation both agree that each may bring claims against the other only in an individual capacity and not part as a plaintiff of a class. Unless agreed by both parties, the arbitrator may not consolidate more than one claim or preside over any form of class proceeding.
